Notice of Respondence to Action

This Court has accepted the case in which       sues you over confirmation of contract invalidation dispute. Enclosed is a copy of the Complaint. The related matters about Respondence to Action are hereby notified as follows:

I. During process of litigation, the parties concerned are entitled to exercise the litigation rights prescribed by Articles 49, 50 and 51, etc. stipulated in Civil Procedural Law of the People’s Republic of China and must abide by litigation order and perform litigation obligations in the meantime.

II. You shall submit a Statement of Defense in quintuplicate to this Court within thirty days after receipt of the copy of the Complaint.

III. Where a party concerned is a legal person or any other organization, the qualification certificate of its legal person or any other organization and the identity certificate of its legal representative or principal shall be submitted. Where a party is a natural person, the identity certificate shall be submitted.

IV. Where a party concerned appoints an attorney to participate in litigation on its behalf, a Power of Attorney signed or sealed by such party shall be submitted. The Power of Attorney shall contain the entrusted matters and specific powers pursuant to provisions stipulated by Article 59 in Civil Procedural Law of the People’s Republic of China.  

 V. Where it is intellectual property rights case, it shall apply to State Intellectual Property Office for invalidation of patent right within fifteen days.    

 VI. Where the parties concerned are willing to reach a compromise on their own or agree to be reconciled by the Court, the parties shall submit a written application to Case Filing Chamber of the Court within the period of Statement of Defense.
